Dual pricing is a payment program where the merchant lists both a cash price and a higher card price for every item, so customers paying by card cover the processing fee through the listed price. Done correctly, dual pricing takes the merchant's net processing cost to near zero. Cash discount is legal in all 50 states; surcharging is legal in 47 states with a 3% Visa cap and a debit-card exemption under the Durbin Amendment.
